The Acton Congress of Nigeria (ACN) has petitioned the Chief Justice of Nigeria, Justice Dahiru Musdapher on the appeal filed by its member, Dr Wale Okediran against the election  of Senator Agboola Hosea, urging him to direct the Court of Appeal to constitute an independent panel of the Court of Appeal to determine the appellant’s application.

The ACN Chairman in Oyo State, who made the appeal along with the party’s state Secretary, Mr Mojefed Olaoye said the inconsistencies in the manner the appeal was being handled by Justice Saulawa had necessitated an urgent intervention by the Chief Justice of the Federation.

The ACN said it had lost confidence in Justice Saulawa whom it alleged had shown open bias against the case filed by the appellant, more so as he had refused to be bound by the judgment of the Supreme Court which allowed the ACN’s case to be heared.

It alleged that Justice Saulawa had halted the process of hearing the ACN appeal contrary to an earlier ruling by the Appeal Court in Ibadan which granted further hearing, a reason it appealed for an urgent intervention by the Chief Justice of Nigeria.

On the alleged bias by Justice Saulawa, the ACN told the Chief Justice of Nigeria that,Honourable Justice   Saulawa shouted down our solicitor to the extent that Mr Akeredolu (SAN)  had to state that it was wrong for that Justice to shout him down and shut him out.

“In actual fact, Justie Saulawa did not allow our solicitor to argue our cross-appeal, but rather declared the case adjourned as Mr Akeredolu (SAN) was about adopting his briefs in the three appeals. It took several verbal exchanges before the presiding justice allowed adoption without elaboration of the brief in the cross-appeal.

“Nobody present in the court room on that day would be surprised when Justice Saulawa dismissed our petition in his judgement delivered on January 24, 2011. He seemed to have come deliberately with an instgruction to do a hatchet job and not justice between the parties.
