Lawyers Commend Supreme Court
Human rights lawyer, Bamidele Aturu, on Friday described the judgment as sound, legal, morally justifiable.
Aturu said, “INEC was wrong in trying to give effect to the 2007 annulled elections in the five states. There is no ambiguity in Section 180 of the 1999 Constitution as amended as it states clearly that the tenure of a governor shall be four years, starting from the day he takes Oath of Office and Oath of Allegiance.”
Reacting, Adegboruwa advised that all matters arising henceforth, from an election should concluded before a declared winners took oath of office.
“Whatever circumstance that may warrant a governor spending a day beyond his first four years term or second eight years is fraudulent. And indeed I have suspected all along that some smart governors may have colluded with fellow politicians to sponsor frivolous election petitions in court as a means of ‘nullifying’ their elections, get the tribunals to order fresh elections, leading to a fresh tenure.
“There is no basis for this constitutional fraud at all. And it is indeed soothing that the Supreme Court has put judicial end to the ambitions of these governors,” he stated.
