Copyright Infringement: Promoter sues Barrister’s distributor, friend

THE Late Sikiru Ayinde Barrister’s distributor, Alhaji Lati Alagbada, the fuji musician’s friend, Alhaji Buhari Oloto, the Inspector General of Police, deputy Commissioner of Police, State CID, Panti, Lagos, and the Investigating Police Officer, Inspestor Ademola, D14 Section, Panti, have been taken to court over rights infringement allegations by a promoter, Alhaji Adegboyega Ademola Otolowo, Mr. Hammed Adepoju and Alhaji Azeez Adisa.

Otolowo alleged, in the case filed at the High Court of Lagos State, that the duo had attacked his marketers for selling a musical work entitled “Barrister: Last Message”.

In the statement accompanying the affidavit in support of the application, they sought a declaration  that the molestation, humiliation, unlawful detention, threat and degrading treatment of the three applicants by the respondents over a civil matter of copyright, allegedly at the instance of the duo is wrongful, unlawful and unconstitutional as it violates a breach of the applicants’ rights.

It also sought, among others, a declaration that the respondents cannot force, coerce or stop the marketing and sale of the musical work in issue titled “Barrister: Last of Message” without a valid order of a court competent jurisdiction, and a perpetual injunction restraining the respondents, whether by themselves or their officers, privies or otherwise called from harassing, detaining, molesting, embarrassing, threatening the Applicants over a purely civil matter of copyright without due compliance with the Constitution.

In the suit no: M/ 1116/12,the trio want the sum of N50m as general damages against the respondents jointly and severally, being exemplary and aggravated damages for the unlawful violations of the applicants fundamental rights a purely civil matter of copyright.

No date has been fixed for hearing yet.
