Obey court order or face consequences, court warns CBN gov

Justice Hussein Baba-Yusuf of the Federal Capital Territory (FCT) High Court, on Thursday, gave the Central Bank of Nigeria (CBN) Governor, Mr Sanusi Lamido Sanusi, a last chance to obey court order or face “the consequences of disobedience.”
Baba-Yusuf gave the warning following complaints by Chief Tochukwu Onwugbufor (SAN), counsel for Chief Chudi Chukwuani, that the CBN had flouted a court order.
It will be recalled that Justice Ufot Inyang of the FCT High Court, sitting in Apo, on August 1, ordered the CBN governor to pay Chief Chukwuani N160 million.
The amount, the court said, was payment for a contract executed by Chukwuani’s company, BPS Engineering Construction Ltd, for the Federal Roads Maintenance Agency (FERMA).
Justice Inyang had given the CBN governor till August 7 to pay Chukwuani or face contempt charges before it proceeded on vacation.
Chukwuani filed a motion before Justice Baba-Yusuf, who is the vacation judge, seeking enforcement of the order on CBN.
At the hearing of the motion for the execution of the court order on Thursday, Onwugbufor told the court that the CBN had not obeyed the order issued by Justice Inyang, and prayed the court to ensure that the bank should comply with the order.
In his ruling, Justice Baba-Yusuf refused an oral application for adjournment by the counsel for the CBN, Kenneth Obi, who held briefs for Chief Olumuyiwa Akinboro.
Baba-Yusuf expressed displeasure at the CBN for refusing to obey the order of Justice Inyang.
“My business today is not to grant adjournment. I have a court order issued by my brother judge ordering the CBN to pay Chief Chukwuani the sum of N160 million. My business is to ensure that the court order is obeyed to the letter. I am giving CBN Governor Sanusi; Mr Emmanuel Malomo, the Senior Manager, Banking Services and Jude Onwuharonye, Manager, Legal Services of the CBN, till the close of work today.
